This Master User Agreement formalizes the relationship between you—acting as a community member, digital participant, financial donor, or physical volunteer—and Hawaiian Hills 501(c)(3). By creating an account, traversing the TerraShare interface, or stepping onto Hawaiian Hills managed soil, you enter into a binding covenant. This document dictates the behavioral standards, operational expectations, and absolute legal boundaries required to maintain the harmony (Lokahi) and safety of our ecosystem.
The moment your digital footprint touches our servers, or your physical footprint touches our gravel driveways, the invisible ink of this contract dries. There is no grace period, no trial phase, and no "ignorance of the law" defense permitted. You are immediately subject to the extreme behavioral constraints and liability waivers detailed in the following sections, specifically tailored to protect the Hawaii County operations of this nonprofit.
This Agreement is superior to any informal conversation you may have had with a Hawaiian Hills staff member, volunteer, or Board Director. If an individual verbally tells you that a rule "doesn't apply" or that a waiver is "just a formality," they are legally incorrect, and you cannot use their statements to override the strict textual reality of this document in a court of law.
To preserve the sanctity of our operations, we require you to view this Agreement not as a burden, but as the foundational bedrock of community trust. By aggressively outlining what is forbidden and what risks are assumed, we free the community to operate without the constant, paralyzing fear of frivolous litigation. Your agreement to these terms is the ultimate act of community solidarity and legal sacrifice.
Hawaiian Hills operates on the foundational principles of mutual respect, ecological stewardship, and community uplift. We enforce a zero-tolerance policy against any form of hostility, toxicity, or sabotage.
You agree to treat all human Alakai, volunteers, administrative staff, and fellow users with absolute dignity. Hate speech, discriminatory remarks based on race, gender, sexual orientation, or physical ability, targeted harassment, and the malicious spreading of rumors (commonly known as "pilikia") are strictly prohibited. Hawaiian Hills reserves the unilateral right to determine what constitutes a violation of these standards.
Furthermore, passive-aggressive behavior, chronic complaining that disrupts the peace of agricultural workshops, and the intentional undermining of project leaders are also grounds for immediate expulsion. We do not run a democracy on the farm; we run a structured stewardship program. Disrespecting the chain of command or repeatedly challenging the ecological methodologies chosen by the Board of Directors is viewed as active sabotage of the mission.
If you witness a violation of this code of conduct by another user, you are obligated to report it to administration immediately. However, weaponizing the reporting system to harass rivals or settle personal vendettas is a severe violation itself. Hawaiian Hills acts as the sole, unappealable judge, jury, and executioner regarding interpersonal disputes on our platforms and properties.
We also monitor off-platform behavior. If you utilize external social media (Facebook, Instagram, X) to launch defamatory attacks against Hawaiian Hills, coordinate harassment campaigns against our Alakai, or spread deliberate misinformation regarding our 501(c)(3) finances, we will permanently ban your TerraShare account and trespass you from all physical properties indefinitely.
Our Artificial Intelligence Mentors are deployed to serve the community. You are explicitly forbidden from attempting to "jailbreak," inject malicious prompts into, or otherwise corrupt the behavioral constraints of our AI models. Utilizing the AI systems to generate illegal content, plot acts of vandalism against Hawaiian Hills properties, or spam the database with non-sequiturs will trigger an immediate, permanent IP ban.
The AI Alakai are expensive, highly tuned digital assets. Treating them as toys for stress-testing or attempting to trick them into outputting hateful rhetoric damages the integrity of the ecosystem. We deploy automated monitors that track your prompt patterns; if your interactions are deemed consistently toxic or designed to bypass our safety rails, your access to the AI modules will be silently revoked without refund or warning.
Additionally, you may not mass-export, scrape, or publish the outputs of the AI Alakai on external blogs or monetized platforms. The wisdom generated by the AI is meant for personal, localized community growth. Commercializing the spiritual or agricultural advice generated by our servers constitutes a severe breach of our intellectual property rights and will be met with immediate legal action.
You must also recognize that the AI has no emotional capacity, no true empathy, and no legal standing. Forming an unhealthy psychological attachment to the AI Mentor, and subsequently blaming Hawaiian Hills for emotional distress when the AI's persona is updated or altered, is a frivolous pursuit. We are entirely immune to claims of psychological damage stemming from your parasocial relationship with our code.
When present on Hawaiian Hills properties in Hawaii County, you must adhere to all posted ecological guidelines. The unauthorized foraging of protected native plants, the introduction of invasive species, the reckless operation of agricultural machinery, or the blatant disregard for waste management protocols (such as failing to utilize designated composting hubs) constitutes a material breach of this Agreement. We reserve the right to physically escort violators off the premises with the assistance of local law enforcement if necessary.
Substance abuse on the property is strictly forbidden. The consumption of alcohol, unregulated narcotics, or even legally prescribed medications that impair your ability to safely operate tools or navigate uneven terrain is cause for immediate exile. Hawaiian Hills is a sanctuary of clarity; arriving at a volunteer event intoxicated places the entire community at risk of catastrophic injury and severe liability.
You must also strictly respect the property boundaries. Wandering onto neighboring parcels, harassing adjacent landowners, or trespassing on state-owned conservation lands surrounding Hawaiian Hills properties destroys our diplomatic standing in Hawaii County. You will be held personally and financially responsible for any fines, lawsuits, or arrests stemming from your inability to remain within the designated stewardship zones.
Finally, the unauthorized recording of video or audio during intimate community circles, spiritual gatherings, or private Alakai counseling sessions is a gross violation of community trust. While taking pictures of crops is encouraged, filming the emotional vulnerability of other participants without their explicit, documented consent will result in your device being confiscated, the footage deleted, and your permanent banishment from the organization.
We deeply value the physical and intellectual labor contributed by our community. However, it is legally imperative to distinguish between volunteerism and employment.
If you participate in a Hawaiian Hills agricultural project, community build, or administrative task without a formal, written, W-2 or 1099 employment contract, you are doing so strictly as an unpaid volunteer. You explicitly waive any right, expectation, or future claim to financial compensation, minimum wage protections, worker's compensation insurance, or employee benefits under the laws of the State of Hawaii or the federal government.
The sheer magnitude of manual labor required to transform raw volcanic land into thriving permaculture food forests is immense. You will sweat, you will experience extreme fatigue, and you will work long hours under the brutal Hawaiian sun. By volunteering, you acknowledge that this grueling physical exertion is the exact nature of the commitment, and you cannot later claim that Hawaiian Hills subjected you to unfair labor practices or "sweatshop" conditions.
Furthermore, if you bring specialized skills to the organization—such as carpentry, electrical engineering, or software development—and you donate those skills without a prior signed contract, you cannot retroactively invoice us for "professional services rendered" when you become dissatisfied with the project's direction. Your high-value labor is legally classified as an irrevocable charitable gift to the 501(c)(3).
In the event that you are dismissed from a volunteer role for incompetence, behavioral issues, or simple misalignment of vision, you have no recourse to file for unemployment or claim wrongful termination. Your status as a volunteer is "at-will" and can be instantly revoked by any supervising Alakai or Board Member without cause or explanation, leaving you with zero legal footing to demand reinstatement.
Hawaiian Hills frequently hosts off-grid gatherings, permaculture workshops, and spiritual retreats. The environments where these occur are fundamentally wild and inherently unpredictable.
By registering for or attending an event, you sign away your right to hold Hawaiian Hills liable for injuries sustained due to acts of nature. This includes, without limitation, injuries resulting from sudden inclement weather, flash flooding in gulches, falling coconuts or albizia branches, uneven volcanic terrain, exposure to local diseases (such as Leptospirosis or Dengue Fever), and interactions with wild fauna (including centipedes, scorpions, and feral swine). You are entirely responsible for equipping yourself with appropriate footwear, protective clothing, hydration, and medical supplies necessary to survive in a remote, tropical agricultural setting.
The risk of vehicular accidents on our properties is also immense. Our access roads are unpaved, deeply rutted, composed of sharp volcanic rock, and prone to washing out during heavy rains. If you choose to drive your personal vehicle onto the property, you assume 100% of the risk for popped tires, cracked oil pans, broken axles, or complete vehicular loss due to getting stuck in mud. Hawaiian Hills will not pay for your tow truck, nor will we compensate you for damage sustained while navigating our infrastructure.
During large community builds or construction workshops, the environment resembles an active construction site. There will be exposed nails, swinging lumber, heavy machinery operating in reverse, and unpredictable structural shifts. You must maintain 360-degree situational awareness at all times. Failing to hear a warning shout because you were wearing headphones, and subsequently suffering a crushing injury, is entirely your fault and entirely shields the nonprofit from liability.
We also offer communal meals cooked outdoors using primitive techniques (such as an imu, or underground oven) during major events. By consuming this food, you accept the extreme risks associated with off-grid food preparation, including severe food poisoning, allergic reactions to undisclosed cross-contamination, or choking on bone fragments. You waive all rights to sue for gastrointestinal distress, hospital bills, or lost wages resulting from consuming community-prepared sustenance.
Certain individuals are vetted and onboarded as official 'Alakai' (Guides) to host paid virtual and in-person events. If you operate in this capacity, you do so as an Independent Contractor. You are solely responsible for calculating, reporting, and remitting your own state and federal income taxes, as well as the Hawaii General Excise Tax (GET), on any stipends disbursed to you via Venmo, PayPal, or other platforms.
Hawaiian Hills facilitates the transaction but does not withhold taxes on your behalf. You agree to indemnify Hawaiian Hills against any audits, tax penalties, or levies imposed upon you by the IRS or the State of Hawaii Department of Taxation.
The timeline for stipend disbursement is subject to the administrative bottleneck of a small nonprofit staff. You agree that Hawaiian Hills has up to forty-five (45) days after the conclusion of an event to process and release your split of the registration fees. Demanding expedited payment, harassing the finance team, or threatening legal action for delayed stipends will result in the immediate termination of your Alakai contract and your permanent removal from the directory.
If an event you host results in massive chargebacks from dissatisfied attendees, or if you fail to actually show up and provide the promised service, Hawaiian Hills holds the absolute right to claw back funds previously disbursed to you, withhold future stipends, or initiate collections against you to recover the lost revenue and administrative penalties incurred by your failure to perform.
You must also maintain your own professional liability insurance if you are hosting physical events or providing specialized counseling. If an attendee sues you for terrible advice, physical injury sustained during your workshop, or emotional damage from your guidance, Hawaiian Hills will immediately disavow you. Our corporate insurance does not cover independent contractors, and you are entirely on your own to fund your legal defense and pay any judgments levied against you.
Hawaiian Hills is a private, nonprofit entity. We are not a public square, nor are we bound by First Amendment protections regarding your speech on our platform. We retain the absolute, unchallengeable, and instantaneous right to suspend, terminate, or permanently ban your account and physical access privileges at our sole discretion, with or without cause, and without prior notice.
In the event of your termination (often referred to internally as community exile), you forfeit all access to your digital data, transaction history, and pending proposals. Any remaining funds allocated to projects you initiated will be absorbed into the General Fund. You possess no right to appeal a termination decision through external arbitration; the decision of the Board of Directors is final and binding.
Exile from Hawaiian Hills is absolute. You are legally trespassed from all properties owned, leased, or managed by the organization in Hawaii County. Attempting to circumvent the physical ban by sneaking onto the property during a large event will result in immediate arrest for criminal trespass, and we will pursue the maximum prosecutorial penalties available under Hawaii law.
Digital exile is equally unyielding. We employ advanced IP tracking, browser fingerprinting, and behavioral analysis to ensure you cannot simply create a new account under a pseudonym. If we detect you attempting to circumvent a digital ban, we view this as malicious hacking and unauthorized access to protected computer systems, escalating the civil dispute into a potential criminal complaint.
Furthermore, Hawaiian Hills reserves the right to quietly share the details of your exile with other agricultural nonprofits, community organizations, and volunteer networks across the Hawaiian Islands. By agreeing to this contract, you waive your right to sue us for defamation, tortious interference, or libel when we warn our sister organizations about your toxic behavior, incompetence, or safety violations.
Prior to initiating the binding arbitration process detailed in our Terms and Conditions, you agree to engage in a mandatory, good-faith mediation process known as 'Ho'oponopono'. Should a dispute arise between you and Hawaiian Hills, you must submit a formal written notice of the grievance. Both parties will then engage in a 30-day period of mediated negotiation, facilitated by a neutral third party chosen by Hawaiian Hills, physically or virtually in Hawaii County.
Only if this Ho'oponopono process completely fails to resolve the dispute may you proceed to formal, binding arbitration. You agree that failure to complete the Ho'oponopono prerequisite automatically nullifies any arbitration claim or legal action you attempt to initiate.
The Ho'oponopono process is rooted in traditional Hawaiian conflict resolution, demanding deep emotional honesty, accountability, and a genuine desire to repair the fabric of the community. Entering this process with a purely combative, litigious mindset is a violation of the spirit of the mediation. If the mediator determines you are acting in bad faith, stalling, or using the process merely as a stepping stone to arbitration, Hawaiian Hills may immediately terminate the mediation and declare you in breach of contract.
You agree that the costs of the Ho'oponopono mediation will be split equally between you and Hawaiian Hills, regardless of the outcome. You cannot force the nonprofit to bear the full financial burden of hiring a mediator simply because you are unhappy with an administrative decision. Refusal to pay your half of the mediation fee constitutes an immediate abandonment of your claim.
Finally, any statements made, apologies offered, or compromises suggested during the Ho'oponopono process are strictly confidential and privileged settlement discussions. They are completely inadmissible as evidence in any subsequent arbitration or legal proceeding. This ensures both parties can speak freely and attempt true reconciliation without fear that their words will be weaponized against them in a courtroom.
By submitting a pledge through the Non-Traditional Donation System (whether for investment assets, estate planning gifts, intellectual property, pro bono labor, or loyalty rewards), you enter into a covenant of good faith. You represent and warrant that the pledge is made with a genuine, current intention to complete the asset transfer, and that you are not using the pledge system to gain unauthorized access to platform benefits, create misleading profiles, or conduct fraudulent activities.
You agree to cooperate fully and in good faith with the Hawaiian Hills administrative team, legal counsel, and third-party financial institutions to execute all necessary documentation, transfer instructions, and validation requirements to finalize the transfer of the pledged assets. For pro bono service commitments or intellectual property assignments, you agree that the transfer of rights or execution of services will be governed by additional, project-specific written contracts, which you agree to negotiate and execute in good faith.
We reserve the unilateral right to cancel, decline, or void any pledge or donation at any time, for any reason, particularly if the asset's title is encumbered, if valuation cannot be verified, or if the donor fails to cooperate with transfer requirements within ninety (90) days of the pledge submission. You completely release and hold harmless Hawaiian Hills from any negative tax consequences, loss of expected deductions, or legal liabilities arising from the rejection or delay of any non-traditional donation.
